oapen.abstract.otherlanguageThe study examines the state control over images of public cultural heritage, unique in Europe for its strictness, which creates a form of “pseudo-copyright” limiting creative use, even for public domain works. The protection of decorum, not foreseen by the Codice dei beni culturali e del paesaggio(Cultural Heritage and Landscape Code), has often justified forms of prior censorship. The possibility of using open licenses, including for commercial purposes, fully compatible with current regulations, is presented. The suggested model overcomes the concessional system, promoting free access, heritage enhancement, and the protection of freedom of expression.
