oapen.abstract.otherlanguageFrom conflict mediation as a path undervalued by the legal culture, we go through the reflection that assigns it the scope of consensual justice, in a relationship of contiguity and coexistence with the civil process, a source of awareness in the conflictual relationship and choice of solutions through peaceful dialogue. The turning point of the legal culture on the issue lies beyond its very essence, because mediation makes people present to their problems, producing the responsibility of choosing between autonomy or delegation. The contribution of the court that welcomes mediation into its culture and practice generates beneficial effects for people, as well as the balanced, expeditious and efficient functioning of the court.
