oapen.abstract.otherlanguageThe article analyses the notion of general strike, based on the indications of the Guarantee Commission for strikes in essential public services. Then, it briefly focuses on the ways in which this instrument was used during the post-constitutional seasons. Subsequently, the attention of the author is dedicated to the general strike of 17th of November 2023, with respect to which some doubts are formulated regarding the intervention of the Commission and above all the ministerial precept. In fact, despite being this general strike proclaimed by two large confederal unions, the Commission denied the “general” nature of the strike assuming the existence of a consolidated orientation on which this position was based. The article questions the position of the Commission on this point.
