        Abstract
        The special rules on unjust enrichment and damages in intellectual property law are subject of a discussion where representatives of civil law criticise them as incoherent in the general system of civil law and representatives of intellectual property law justify this incoherence with their practical utility. This book shows that it is important to bring general civil law in dialogue with the rules of “special private law” in order to link practical utility and theoretical coherence and to realize pragmatic solutions for certain cases within the frame of a coherent legal system.
         
        Die immaterialgüterrechtlichen Sonderregeln für Bereicherungs- und Schadenersatzansprüche sind Gegenstand einer Diskussion, in der Vertreter des allgemeinen Zivilrechts die Sonderbestimmungen als systemwidrig kritisieren und Vertreter des Immaterialgüterrechts den Systembruch mit ihrer praktischen Nützlichkeit rechtfertigen. Dieses Buch zeigt, dass es darauf ankommt, das allgemeine Zivilrechtssystem und sonderprivatrechtliche Regelungen in einen Dialog treten zu lassen, um praktische Nützlichkeit und theoretische Kohärenz zu verbinden und einzelfallbezogene Pragmatik im Rahmen eines widerspruchsfreien Gesamtsystems zu verwirklichen.

        Export search results

        The export option will allow you to export the current search results of the entered query to a file. Differen formats are available for download. To export the items, click on the button corresponding with the preferred download format.

        A logged-in user can export up to 15000 items. If you're not logged in, you can export no more than 500 items.

        To select a subset of the search results, click "Selective Export" button and make a selection of the items you want to export. The amount of items that can be exported at once is similarly restricted as the full export.

        After making a selection, click one of the export format buttons. The amount of items that will be exported is indicated in the bubble next to export format.
