        Abstract

The phenomenon of abuse of official authority is widespread in all societies. In contrast to Germany, the Italian legislature has made abuse of office a punishable offense in Article 323 of the Code of Criminal Procedure. The offense has recently gained notoriety in Germany as a result of the indictment of high-ranking politicians in Italy. The provision has a turbulent history and has been the subject of intense scholarly debate in Italy. The present paper addresses this issue by explaining the elements of the crime. In addition, it examines the reasons for the lack of a corresponding norm in German law and the extent to which incrimination of the misappropriation of official powers could be considered in Germany from the standpoint of punishability and the need for punishment.
