    Die Kritik der marxistischen Rechtstheorie: Zu Paschukanis’ Begriff der Rechtsform

    Abstract
    Eugen Pashukanis’ concept of the legal form culminates in the dialectics of freedom and domination of bourgeois society. In this context, law is not understood as an instrument, but is deliberated upon as a form, independent of its concrete content. Against the utopian attempt to imagine a beyond of law, Pashukanis’ theory of law is, at last, asserted not as a theory of how law should be, but as a theory of how law should be conceptualized and, that is, criticized.
     
    In Eugen Paschukanis Begriff der Rechtsform kulminiert die Dialektik von Freiheit und Herrschaft der bürgerlichen Gesellschaft. Dabei wird das Recht nicht als Instrument verstanden, sondern unabhängig von seiner konkreten inhaltlichen Ausgestaltung als Form reflektiert. Gegen den utopischen Versuch, ein Jenseits des Rechts zu imaginieren, wird Paschukanis Rechtstheorie zuletzt nicht als Theorie, wie das Recht sein soll, sondern als Theorie, wie das Recht erkannt und das heißt zugleich kritisiert werden soll, geltend gemacht.

    Export search results

    A logged-in user can export up to 15000 items. If you're not logged in, you can export no more than 500 items.
