    Abstract
    Despite increasing prevalence and relevance, fundamental questions about economic justification remain unresolved: Are there relationships and connections between different use cases? Is there a uniform concept? How should economic entitlement be classified in legal dogmatic terms? In order to clarify this, this dissertation analyzes the most important concepts of economic entitlement and examines them for content, functional and structural similarities in order to develop dogmatics of economic entitlement. It turns out that there is no uniform concept of economic entitlement. However, the structural and functional similarities condense into a legal figure of economic entitlement, which provides important insights for practice and legislation.
     
    Trotz zunehmender Verbreitung und Relevanz sind grundlegende Fragen zur wirtschaftlichen Berechtigung ungeklärt: Gibt es Verwandtschaften und Zusammenhänge zwischen verschiedenen Anwendungsfällen? Gibt es ein einheitliches Konzept? Wie ist wirtschaftliche Berechtigung rechtsdogmatisch einzuordnen? Um das zu klären, werden in dieser Dissertation die wichtigsten Konzepte wirtschaftlicher Berechtigung analysiert und auf inhaltliche, funktionale und strukturelle Gemeinsamkeiten hin untersucht, um eine Dogmatik der wirtschaftlichen Berechtigung herauszuschälen. Es zeigt sich, dass es kein einheitliches Konzept wirtschaftlicher Berechtigung gibt. Die strukturellen und funktionalen Gemeinsamkeiten verdichten sich jedoch zu einer Rechtsfigur der wirtschaftlichen Berechtigung, aus der sich wichtige Erkenntnisse für Praxis und Gesetzgebung ergeben.

    Export search results

    The export option will allow you to export the current search results of the entered query to a file. Differen formats are available for download. To export the items, click on the button corresponding with the preferred download format.

    A logged-in user can export up to 15000 items. If you're not logged in, you can export no more than 500 items.

    To select a subset of the search results, click "Selective Export" button and make a selection of the items you want to export. The amount of items that can be exported at once is similarly restricted as the full export.

    After making a selection, click one of the export format buttons. The amount of items that will be exported is indicated in the bubble next to export format.
