    Dürfen Freiheitsstrafen in Strafbefehlen ausgefällt werden?

    Abstract
    Custodial sentences are among the most severe sanctions that can be imposed by a state. The European Convention on Human Rights therefore guarantees that custodial sentences may only be imposed by a court. However, the reality in Switzerland is different. Three out of four custodial sentences are not imposed by courts, but by public prosecutors in sentencing orders. This paper takes a critical look at this practice and argues that custodial sentences should not be handed down in summary penalty orders.
     
    Freiheitsstrafen gehören zu den schwerwiegendsten Sanktionen, die von einem Staat verhängt werden können. Die europäische Menschenrechtskonvention garantiert deswegen, dass Freiheitsstrafen nur durch ein Gericht ausgesprochen werden dürfen. Die Realität sieht in der Schweiz allerdings anders aus. Drei von vier Freiheitsstrafen werden nicht durch Gerichte, sondern durch Staatsanwälte in Strafbefehlen angeordnet. Die vorliegende Arbeit setzt sich kritisch mit dieser Praxis auseinander und legt dar, dass Freiheitsstrafen nicht in Strafbefehlen ausgefällt werden dürfen.

    Export search results

    The export option will allow you to export the current search results of the entered query to a file. Differen formats are available for download. To export the items, click on the button corresponding with the preferred download format.

    A logged-in user can export up to 15000 items. If you're not logged in, you can export no more than 500 items.

    To select a subset of the search results, click "Selective Export" button and make a selection of the items you want to export. The amount of items that can be exported at once is similarly restricted as the full export.
